Each product sold by Dien to a final customer is covered by a legal warranty which covers conformity defects that appear within 24 months from the date of delivery of the goods.

What is Legal Warranty?

This is the warranty on consumer goods’ sale provided by the EU Directive 1999/44 / EC, also known as the “Warranty of conformity”, which protects you if the products you purchase have conformity defects compared to the sale contract (“Legal Warranty”).

This happens, for example, in the case of products that don’t work well, which cannot be used how declared by the seller or for the purposes for which products of the same type are generally used, which do not have the characteristics or qualities assured by the seller or that do not respond to the use for which you purchased them.

What is the duration of Legal Warranty?

The Legal Warranty covers conformity defects that occur within 24 months from the delivery date of the product you purchased, even if the defect was not immediately detectable on that date. To assert it, you must communicate to Dien Group s.r.l. the presence of the defect within 2 months from when you found it.

Otherwise, it is assumed that the lack of conformity that occurs within the first 6 months from the date of delivery of the goods already existed on that date, unless this hypothesis is not compatible with the nature of the goods or with the nature of the defect of compliance.

We recommend you to keep always the purchase receipt that you find in the product package, as well as the documents confirming the shipment and delivery of the product.

Am I entitled to Legal Warranty?

The legal warranty is addressed to consumer only, that is who purchase products for non-professional purposes. For example, if you buy an Ozone Generator exclusively for your personal use, you are entitled to the Legal Warranty. On the contrary, if you buy it to use it in your activity or job, Legal Warranty cannot be applied.

Against who can I enforce the Legal Warranty?

If you are a consumer you can enforce the Legal Warranty against whoever you sold the product, even if he’s a person different from the manufacturer. Dien is therefore responsible for the products purchased by Dien. For products sold by third parties, for example by resellers or Dien websites or in local shops, the Legal Warranty is the responsibility of the seller and Dien has no responsibility in this concern.

What rights does Legal Warranty give me?

If the product you purchased has a defect covered by the Legal Warranty, you are entitled, without incurring any expense, to the repair or replacement of the defective product by the seller. You are entitled to a price reduction or dissolution of the contract in the following cases: (a) if the replacement or repair of the product is not possible or is excessively expensive; (b) if the seller has neither repaired nor replaced the product within a reasonable period of time; or (c) if the product’s replacement or repair has caused you significant inconvenience. In order to determine the amount of the price reduction or the amount to which you are entitled in these cases, it’s important to understand how you used the product. It is really important to keep in mind that a minor defect for which it has not been possible or excessively expensive to carry out the resolutionss for repair or replacement does not give the right to terminate the contract.

Customer Service will help you solve the problem found on the product you purchased.

If we noticed that the problem is due to a lack of conformity, a claim will be opened in your name and you will received a code for the repair or free replacement of the product under warranty.

Please note that, in case of replacement, we will deliver the replaced product to you within a reasonable time and you will be required to return the non-compliant product to our Company within 30 days from the date you received our notification for product’s replacement.
